D'Artagnan Privacy Policy

D’Artagnan, Inc. ("D’Artagnan," “we” or “us”) is committed to transparency. This privacy policy (the "Policy") describes how D’Artagnan collects, uses, discloses and otherwise processes the personal information described in this Policy, as well as the rights and choices individuals have regarding such personal information.

Scope

Except as otherwise noted below, this Policy applies to the personal information that D’Artagnan collects, uses, discloses, and otherwise processes about consumers, including related to:

  • Our websites where this Policy is posted, including www.dartagnan.com (each a “Site” and collectively the “Sites”), and the interactive features, applications and online services we make available through our Sites or to enable you to access our Sites (collectively, and including the Sites, the “Online Services”);
  • Current, former and prospective customers, vendors, and partners, as well as users of our Online Services;
  • Individuals who subscribe to receive news, information and marketing communications from us;
  • Individuals who participate in contests, sweepstakes, promotions, events, surveys and research conducted (collectively, “Events”) by us; and
  • Individuals that communicate with us or otherwise engage with us related to the Online Services, our Events, or the products and services we provide.

In some cases, additional or supplemental privacy notices (each an “additional notice”) may be provided and will apply to certain personal information collected and processed by us. The additional notice will control to the extent there is a conflict with this Policy, with respect to your personal information that is subject to that notice. As further set forth below, D’Artagnan will revise and update this Policy as D’Artagnan changes its practices or adds new products or services or changes existing ones. You should refer back to this page for the latest information.

Personnel. This Policy does not apply to the personal information that we collect and process about employees and other personnel.

D’Artagnan is located in and operated from the United States and our products and services are available only for shipping to addresses within the United States. Any personal information we collect will be transferred to, and processed and stored in, the United States. If you are located outside of the United States, please be aware that data protection laws in the United States may differ from those where you are located, and your personal information may be subject to access requests from governments, courts, or law enforcement in the United States.

Your use of our Online Services (including any Site), and any dispute over privacy, is subject to this Policy and our Terms of Use, (posted at www.dartagnan.com/general/terms-of-use.html), including their applicable limitations on damages and the resolution of disputes.

INFORMATION WE COLLECT

As further described below, we collect personal information directly from individuals, as well as automatically and from third parties. We may also combine the personal information that we collect from these different sources.

Personal Information We Collect Automatically. The personal information we collect from you depends upon how you use our Online Services or otherwise interact or engage with us, but generally includes:

  • Profile information: We collect information you give us-such as your name, billing and shipping address, phone number, email address, and/or credit card number-when you purchase a product, use a service, participate in a promotion, or register for an account for the Online Services. In addition, if you apply for a job with us, we will collect your name, contact information, resume, qualifications and other information that you submit to us.
  • Payments and orders: When you make a purchase or payment, we collect purchase and payment information in order to process your payment, such as your credit card number and applicable shipping and billing address. If you shop for or purchase our products and services online, we also maintain records about your past purchases, as well as items that you view or add to your cart. In some cases, such as gift purchases, we may collect information about someone other than you, including that person's name, shipping or mailing address, telephone number, and e-mail address. Please be aware that when you use any send-to-a-friend functionality on the Sites or otherwise request us to ship to a third party, your contact information, name or username and message may be included in the communication sent to your addressee(s).
  • Communications and interactions: When you email, call, or otherwise communicate with us, we collect and maintain a record of your contact details, communications and our responses. We also maintain records, communications and information that you post in chat sessions, forums and in other areas of the Services, well as on our social media channels, and information you provide to us related to any customer support requests.
  • User Content: The D’Artagnan Sites may permit you to post comments, reviews, photographs and other information that is publicly-accessible (collectively, "User Content"). Keep in mind that others may have access to your User Content and may have the ability to share it with third parties. Please think carefully before deciding what information you share, including personal information, in connection with your User Content. D’Artagnan does not control who will have access to your User Content or their respective privacy and security practices.
  • Sweepstakes, contests and promotions: If you participate in sweepstakes, contests and promotions that we offer, we will collect your name, age, email address, and other registration information related to contests, sweepstakes and promotions. If you sign up to receive promotional texts and emails from us, we will collect your name and contact information.
  • Events and other requests: We also collect personal information related to your participation in our events as well as other requests that you submit to us related to our Services. For example, if you register for or attend an event that we host or sponsor, we may collect information related to your registration for and participation in such event. When you fill out a ‘Contact Us’ form, signup for our mailing lists, or otherwise request information from us, we collect and maintain records of your requests.

Information We Obtain from Other Sources. We may obtain information about you from outside sources such as:

  • Credit information, which allows us to complete transactions for the purchase of our products and services;
  • Demographic and marketing information from third parties, which aids us in serving you and informing you of products and services that may be of interest to you;
  • Information submitted by third parties, such as the send to a friend functionality;
  • Updated delivery and address information from our shipping agents and other sources, which permits us to maintain accurate records and better serve you; and
  • Email and contact lists from third party partners.

Personal Information We Collect Automatically or Infer About You. We automatically collect certain types of information when you use our Online Services or interact with us. For example, we use cookies, log files, pixel tags and other tracking technologies to automatically collect information when users access or use our Online Services, such as IP address, general location information, domain name, page views, a date/time stamp, browser type, device type, device ID, Internet service provider, referring and exiting URLs, operating system, language, clickstream data, and similar device and usage information. For more information, see the “Tracking Technologies” section, below. In addition, we may combine and analyze the information we collect about you in order to develop inferences about you, such as your preferences and shopping habits.

Aggregate and Non-identifiable Data. We may also collect, derive and process aggregate and other non-identifiable information—this information is not personal information under this Policy. Aggregate data includes, for example, a report that indicates that a certain number of our customers reside in a particular state or region of the United States, or a report on how many of our customers visited particular pages of one of the D’Artagnan Sites. This information aids us in understanding trends and customer needs so that we can better consider new products and services or tailor existing products and services to customer preferences.

COLLECTION, USE AND PROCESSING

Generally, we collect, use, disclose and otherwise process the personal information we collect for the following purposes:

  • Services and support: To provide services and support related to the Online Services and our other products and services. This includes, for example, communicating with you about our products and services and your use of the Online Services, providing troubleshooting and technical support, responding to requests, fulfilling orders, processing payments, contacting you about your orders, scheduling deliveries, and similar customer service and support purposes.
  • Order status: To send you order updates, delivery confirmation, order tracking details, and other transactional information, including text updates if you have opted in to these.
  • Responding to you: To respond to your inquiries and requests and to send you news, offers or other information that you sign up to receive. In addition, if you apply for a job with us, we use your personal information to consider you for the position for which you have applied, identify other positions that may be a good fit, and to communicate with you about your application or other positions that may be a good fit.
  • Analytics and improvement: To evaluate and improve our business operations, the Online Services, and our other products and services. For example, we may collect analytics data on our Sites to better understand how customers access and use them and improve customer experiences. We may also use the personal information that we collect for quality control and training purposes, and for other internal research, development and analytical purposes.
  • Customization and personalization: To personalize experiences and tailor content on the Online Services, including to offer location customization and personalized help and instructions, and to otherwise personalize your experiences.
  • Marketing and advertising: For marketing and advertising purposes, including to: (i) send you cart reminders, offers, promotions, newsletters and other marketing emails about our products and services and those of our affiliated companies and brands; (ii) email you about third-party products and services that we think may interest you; (iii) to send you other information that you sign up to receive, such as marketing and promotional texts; and (iv) help us manage and improve our advertising campaigns and reach people with relevant ads and content, including on third-party sites and services.
  • Planning and managing events: For event planning and management, including registration, attendance, connecting you with other event attendees, and contacting you about relevant events and Services.
  • Research and surveys: To administer surveys and questionnaires, such as for market research or customer satisfaction purposes.
  • Security and protection of rights: To protect the Online Services and our business operations; to prevent, detect and respond to fraud, unauthorized access, and other misuse; where we believe necessary to investigate or take action regarding illegal activities, suspected fraud, potential threats to the safety or legal rights of any person or third party, or violations of our Terms of Use.
  • Compliance and legal process: To comply with the law and our legal obligations, to respond to legal process, and as part of other legal proceedings.
  • General business and operational support: To consider and implement mergers, acquisitions, reorganizations, bankruptcies, and other business transactions, and related to the administration of our general business, accounting, auditing, compliance, recordkeeping, and legal functions.

DISCLOSURES OF PERSONAL INFORMATION

We may disclose the personal information that we collect for the purposes described above and as otherwise directed or consented to by you, including to:

  • Vendors and service providers: We may disclose personal information we collect to our service providers, processors and others who perform functions on our behalf. These may include, for example, IT service providers, help desk, payment processors, analytics providers, consultants, auditors and legal counsel.
  • Our affiliates and subsidiaries: We may disclose personal information we collect to our affiliates or subsidiaries, who will use and disclose this personal information in accordance with this Policy.
  • Other users: If you post comments or reviews within the Online Services, this information will be viewable by other users.
  • Third party platforms and providers: We may disclose or make available personal information to third party platforms and providers that we use to provide or make available certain features or portions of the Services, or as necessary to respond to your requests.
  • Online advertising and analytics: We may also disclose or provide personal information to third parties in support of our marketing, advertising and campaign management, including measuring and delivering targeted advertising to users on third party sites and services. As further described in the “Tracking Technologies” section below, we may disclose or provide information to third parties via cookies and other tracking technologies within the Online Services, in order deliver and measure targeted advertising and content across third party sites and services. We may also share certain customer list information (such as your name, email address and contact information) with third parties, to help us reach you and others like you with targeted advertising on third party sites and services. You can opt out of this type of sharing as set forth in the “Privacy Rights and Choices” section below.

In addition, we may disclose your personal information to third parties as follows:

  • Promotions: If you choose to enter a sweepstakes, contest or other promotion we offer, personal information may be disclosed to third parties or the public in connection with the administration of such promotion, including, in connection with winner selection, prize fulfillment, and as required by law or permitted by the promotion’s official rules, such as on a winners list.
  • Order fulfillment: Your name and contact information may also be shared with fulfillment and delivery partners, in order process, fulfill and deliver your orders.
  • Business transfers and corporate transactions: If we or our affiliates are or may be acquired by, merged with, or invested in by another company, or if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the personal information we have collected to the other company. We may also share certain personal information as necessary prior to the completion of such a transfer, such as to lenders, auditors, and third-party advisors, including attorneys and consultants, as part of due diligence or as necessary to plan for the transfer.
  • Compliance and legal obligations: We may also disclose personal information to third parties to comply with our legal and compliance obligations and to respond to legal process. For example, we may disclose information in response to subpoenas, court orders, and other lawful requests by regulators and law enforcement, including responding to national security or law enforcement disclosure requirements. This may include regulators, government entities, law enforcement, and others as required by law or legal process.
  • Security and protection of rights: We may disclose personal information where we believe doing so is necessary to protect the Online Services or our business operations, rights and property, as well as the rights, property and safety of others. For example, we may disclose personal information in order to (i) prevent, detect, investigate and respond to fraud, unauthorized activities and access, illegal activities, and misuse of the Services, (ii) situations involving potential threats to the health, safety or legal rights of any person or third party, or (iii) enforce, and detect, investigate and take action in response to violations of, our Terms of Use. We may also disclose information, including personal information, related to litigation and other legal claims or proceedings in which we are involved, as well as for our internal accounting, auditing, compliance, recordkeeping, and legal functions.

TRACKING TECHNOLOGIES

We use various methods and technologies (“Tracking Technologies”) within the Online Services to store or collect user and activity information, enable certain features and functionality, and operate and secure the Online Services. Some of these Tracking Technologies are provided by third parties. Tracking Technologies may set, change, alter or modify settings or configurations on your device, or collect, store or transmit information about you and your activities within the Online Services. For example:

  • Cookies: Browser (or HTTP) cookies are alphanumeric identifiers that we transfer to your device’s hard drive through your web browser for record-keeping purposes. We use these in the Online Services to, for example, make it easier for you to navigate our Online Services, enable a faster log-in process, support the security and performance of the Services, or allow us to track activity and usage data.
  • Pixels: Pixels (sometime called web beacons, pixel tags, or clear GIFs) are tiny graphics with a unique identifier, similar in function to cookies. While cookies are stored locally on your device, pixel tags are embedded invisibly within web pages and online content. We may use these in connection with our Online Services to, for example, track the activities of users, help us manage content, and collect usage information. We may also use these in HTML e-mails we send, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

In addition to cookies and pixels, we may also use other Tracking Technologies (including third-party Tracking Technologies), including embedded scripts, browser fingerprinting, ETags, plug-ins, mobile SDKs, APIs, and location detection and other recognition technologies, for similar purposes.

How We Use Tracking Technologies. We and our third-party providers use Tracking Technologies to automatically collect user data and browsing, activity, device and similar information within our Online Services (including our HTML emails). We may use this information, for example, to: analyze and understand how users access, use and interact with our Online Services and content; measure and deliver targeted advertising, content and marketing, including on third party sites and services; detect and remember user preferences and settings; personalize user experiences; identify and resolve bugs and errors; and evaluate, secure, optimize and improve the performance of our Online Services. We also use Tracking Technologies to provide certain features and functionality (e.g., login, checkout and payment options), enable third party services (e.g., social media features), secure the Online Services (e.g., detect and prevent bots and other malicious activity), and protect against fraud and misuse. You have certain choices about our use of Tracking Technologies, as described below in this section.

Third-Party Analytics and Tools. We use third party tools, such as Google Analytics, which are operated by third party companies. These third-party analytics companies may collect usage data (using cookies, pixels and similar tools) about our Online Services in order to provide us with reports and metrics that help us to evaluate usage of our Online Services and improve performance and user experiences. Targeted Advertising. We work with third parties, such as ad networks, channel partners, mobile ad networks, analytics and measurement services and others (“third-party ad companies”) to personalize content and display ads within our Online Services, and to deliver and measure our targeted advertising and content on third-party sites, mobile apps and online services. We may disclose or make available certain information to these third-party ad companies, such as IP address, location information, device ID, cookie and advertising IDs, and other identifiers, as well as browsing and activity information. This information may be used to deliver more relevant ads and content (on behalf of us and other third parties) across third party sites and online services, to evaluate the success of such ads and content, and to personalize content and experiences within our Online Services.

Your Choices About Tracking Technologies. There are several ways for you to manage your preferences regarding targeted advertising and Tracking Technologies within our Online Services. Most of these are browser and device specific, which means that you need to set the preference for each browser and device you use to access our Online Services; in addition, if you delete or block cookies, you may need to reapply your preferences. Keep in mind that even if you opt out, you may continue to receive generic or “contextual” ads from us and others.

  • Site preferences: You can review or change your cookie preferences for our Sites and opt-out of targeted advertising and third-party cookies, by clicking the “Cookie Settings” link in the footer of our Sites and adjusting your cookie settings.   • Browser signals: We recognize global privacy control—or GPC— signals (find more about GPC here). If your browser is transmitting GPC signals when you visit one of our Sites, we will opt your browser out of targeted advertising (which may also be considered “sales” or “sharing” under some privacy laws) and other optional third-party cookies on that Site. If you use multiple devices or browsers, you will need to apply GPC for each browser and device that you use to access our Sites. Our Sites do not recognize or respond to browser “do not track” signals.

Industry Ad Choice Programs. You can also control how participating third-party ad companies use the information that they collect about your visits to our Sites, in order to display more relevant targeted advertising to you. If you are in the U.S., you can obtain more information and opt out of receiving targeted ads from participating third-party ad networks at aboutads.info/choices (Digital Advertising Alliance). You may also download the DAA AppChoices tool (https://youradchoices.com/appchoices) to help control interest-based advertising on apps on your mobile device).

Financial Incentives and Bona Fide Loyalty Programs

We offer certain rewards and programs that are considered financial incentives or bona fide loyalty programs under certain state privacy laws, including incentives to customers that sign up for marketing communications or opt-in to other promotional programs. For example, users can sign up for our marketing emails in order to receive a discount off their first order of $100 or more. To sign up, you must provide your email address and consent to receive marketing emails from D’Artagnan. You can unsubscribe from our marketing emails at any time by using the unsubscribe link in the footer of each marketing email that we send. The value of the financial incentives we offer are reasonably related to the expenses of the financial incentive program (including the value of the discount provided and the administrative expenses of such offerings).

CHILDREN AND MINORS

We understand the importance of protecting children’s privacy in the interactive world. We are a general audience service and, and D’Artagnan does not knowingly collect any personal information from children under the age of 13 or minors under the age of 18.

SECURITY

We have implemented safeguards that are designed to protect the personal information we collect. However, no data transmission over the Internet, mobile networks, wireless transmission or electronic storage of information can be guaranteed to be 100% secure. D’Artagnan cannot ensure the security of any information you transmit to us, and you use the D’Artagnan Sites and provide us with your information at your own risk.

THIRD PARTY SERVICES AND LINKS

Our Sites may contain links to third party sites or services whose information practices may be different than ours. We have no control over information that is submitted to, or collected by, these third parties. You should review privacy notices for these third parties. Please be advised that D’Artagnan has no control over the security of other sites on the Internet you might visit, interact with, or from which you might buy products or services.

PRIVACY RIGHTS AND CHOICES

We make available a number of ways that you can manage your privacy choices and submit privacy requests to us. These include:

  • Review your information: You can update much of the personal information we maintain about you, by logging into your account and updating your profile information. You may also submit a privacy request to access, update or delete certain personal information via our privacy request webform (available here).
  • Site preferences: You can opt-out of manage your preferences for targeting advertising (including sales and sharing) via cookies and other technologies on our Sites by either: (i) turning on GPC signals for your browser; or (ii) clicking the “Cookie Settings” link in the footer of one of our Sites and adjusting your cookie preferences for that Site. Your preferences are browser and device specific, which means that you need to apply them for each browser and device you use to access a Site; in addition, if you delete or block cookies, you may need to reapply your preferences.
  • Marketing communications: You can opt out of marketing emails from us by using the unsubscribe link in the footer of each marketing email we send to you.

Additional Privacy Rights. Some state privacy laws provide consumers with specific additional privacy rights regarding their personal information, including:

  • Correction: to correct inaccuracies in their personal information, taking into account the nature and purposes of the processing of the personal information.
  • Deletion: to delete their personal information provided to or obtained by us.
  • Access: to confirm whether we are processing their personal information and to obtain a copy of their personal information in a portable and, to the extent technically feasible, readily usable format.
  • Opt-Out: to opt out of certain types of processing (if applicable), including:
    • to opt out of the “sale” of their personal information.
    • to opt out of targeted advertising by us.
    • to opt out of automated decision-making (which includes processing your personal information to profile you, in order to make automated decisions about you that produce legal or similarly significant effects.
  • Withdraw consent: where you have consented to our collection and processing of your sensitive personal information, or other processing, the right to withdraw your consent at any time.
  • Appeal: to appeal our denial of your privacy request, which you can do by submitting a request through our webform.

Depending upon your state of residence, you may have some or all of the above rights under applicable state privacy law, subject to certain limitations. We do not discriminate against consumers for exercising their state privacy rights. You may submit a request to exercise your privacy rights as follows:

  • Opting out: To opt out of targeted advertising via cookies and other technologies on our Site: (i) turn on GPC signals for your browser; or (ii) click the “Cookie Settings” link in one of our Sites and click the “select Essential Cookies Only” button, to turn off targeted advertising and other optional cookies for that Site.
